The State of New York imposes stricter penalties for drivers who are convicted of driving while intoxicated while having passengers under the age of 16 in the vehicle. Known as Leandra's Law, the Child Passenger Protection Act creates a felony level DWI charge, with stricter penalties for those offenders.

In addition to more severe sanctions for drunk drivers with children in their cars, courts are required to order all individuals convicted of felony or misdemeanor drunk driving to install, use and pay monthly for ignition interlock devices (IIDs) in their vehicles, in addition to all of the other terms of their sentences.
